1.              Introduction

Pursuant to Article 3 (3) of Regulation (EU) 2023/2854 (the “Data Act”), we hereby inform you, as a user of TiVo Smart TV Service and/or DTS Autostage Video powered by TiVo, about our related services, the product data generated by them, and your options for accessing this data.

1.1           Data Holder

The Data Holder is TiVo Platform Technologies LLC (“TiVo”, “we” or “us”), a Delaware corporation with company number 7378901, whose headquarters are located at 2190 Gold Street, San Jose, California, USA 95002.

1.2           Related Services covered

This pre-contractual Information applies to the following services (which are ‘related services’ in respect of your smart TV and/or vehicle (as applicable), for the purposes of the Data Act) (each a “TiVo Related Service”):

–        TiVo Smart TV Service (“TiVo OS”), an operating system that delivers a customized video experience on Smart TVs, giving users access to multiple video sources e.g., streaming services and on demand content on a personalised basis.

  • DTS Autostage Video Powered by Video (“Autostage Video”), an application that delivers customized video experience in your car, giving users access to multiple video sources e.g., streaming services and on demand content on a personalized basis.

 

2.              Product Data and Related Service Data covered

2.1           Data type, volumes and frequency of generation.

The Service(s) listed in Section 1.2. collects the following data:

Voice command/search data (if you enable this function, as further specified in the privacy statement for the applicable TiVo Related Service) The volume of data generated will depend on the frequency and duration of your usage of the voice command/ search functionality on your smart TV or vehicle (as applicable). The frequency of data generated will depend on the frequency of your usage of the voice command/ search functionality on your smart TV or vehicle (as applicable).

 

2.2           Data storage methods and retention periods.

The generated data is stored in AWS, i.e. cloud storage.

As the generated data constitutes personal data, the retention period is determined in accordance with the provisions of the GDPR – please see the privacy statement for the applicable TiVo Related Service for further details.

2.3           How data can be accessed, retrieved, and erased.

You can access, retrieve or request erasure (subject to GDPR carve-outs) of the data via TiVo’s data subject request webform, available at https://xperi.com/privacy-webform, or by contacting TiVo using the methods set out in the privacy statement for the applicable TiVo Related Service.

2.4           Whether and how we or third parties will use the data

(a)            We intend to make use of the readily available data for our own purposes, including but not limited to, for (i) the performance of the TiVo Related Service Terms and Conditions or other agreements with you, or activities related to this, (ii) the provision of maintenance services or support to you or the assessment of claims by you, us, or third parties in relation to the TiVo Related Service, (iii) the monitoring, maintenance, and improvement of the functionality and security of our systems and the TiVo Related Service, (iv) the improvement of the functionality and security of other systems or services offered by TiVo, (v) the development of new systems or services, including artificial intelligence solutions, and/or (vi) the combination of the data with other data or the creation of derived data, for any lawful purpose, such as analysis and evaluation or selling such data to third parties (subject to compliance with GDPR).

(b)            We may allow one or more third parties, such as affiliated companies within our corporate group, business partners, service providers and advertising partners, to access and use the data for purposes that have been agreed upon with you, including:

  • assisting us in achieving the purposes permitted under clause 2.4.(a);
  • achieving, in collaboration with us as data holder or through special purpose companies, the purposes permitted under clause 2.4.(a);
  • in relation to any of their own purposes, independent from TiVo, to the extent lawfully permitted.

 

(c)            We may use services, e.g. cloud computing services, that process the data on our behalf to achieve the agreed purposes under clause 2.4.(a). The third parties referred to at clause 2.4(b) may also use such services to for the purposes set out at clause 2.4(b).

2.5           Data sharing and termination processes.

You can request that the data are shared with a third party as follows:

(a)            contacting TiVo using the contact methods set out in the privacy statement for the applicable TiVo Related Service; or

(b)            providing the third party with the relevant details about your device required to make a request via the webform available at https://xperi.com/privacy-webform.

 

You can request the end of the data sharing by contacting TiVo using the contact methods set out in the privacy statement for the applicable TiVo Related Service.

2.6           Complaint and redress rights.

You have the right to lodge a complaint with the competent supervisory authority pursuant to Article 37 of the Data Act if you believe that your rights under Capital II of the Data Act have been violated.

2.7           Information on duration and termination of the contract.

The terms and conditions for the applicable TiVo Related Service govern the duration and termination of your contract for that TiVo Related Service.
