Xperi Inc. and subsidiaries (“Xperi”, “us,” “we,” or “our”) issue this Privacy Policy (or “Global Privacy Policy” or “Policy”) to describe how and why we collect, use, store, analyze, disclose, transfer and share (“process”) your information and what rights you have in regarding such processing. The information we process may include “personal information” and “personal data” as those terms are defined under applicable privacy laws.
Unless otherwise indicated for a particular product or service, this Privacy Policy applies to all websites where it is posted (collectively, the “Websites”). Please remember that our Terms of Use may also govern your use of the Websites. If a different Xperi privacy policy is presented with respect to the product, service, or entity with which you interact that conflicts with this Global Website Privacy Policy, the privacy policy for that product, service, or entity will be the governing privacy policy of that interaction with respect to the conflict. Xperi is considered to be a “controller” of your information under data privacy regulations when we provide the Websites to you.

When you interact with our Websites, we collect information that relates to you and your interactions with Xperi as described below.

A. Information You Provide.
- When you interact with us or our Websites, we may collect information, including your name, email address, phone number, job title, employer, and login information.
- You may provide this information when you interact with the Websites, such as when you create a customer account with us or request information about our Websites or products.
- You may also provide us with your information when you provide feedback about our Websites, or participate in promotions, contests, sweepstakes, or surveys.

B. Information from Third Parties.
- If you interact with Xperi through a third-party, we may receive information from that third-party when you directed or consented for them to disclose it to us. That could include signing up for contests or sweepstakes, or participating in surveys, offered by other parties that feature our products or Websites.
- The information that you disclose to third parties is not controlled by Xperi or covered by this Policy. We encourage you to review third-party policies and privacy settings so that you understand how the information you disclose may be used or disclosed to others.

C. Information Collected Automatically.
- We may automatically collect some information about how you use the Websites when you interact with us.
- This could include information about the devices you use to access the Websites, such as device identifier, hardware model, operating system version or mobile network information, geolocation information, language preferences, and performance and diagnostic data regarding your use of the Websites.
- This could also include information about how you use the Websites, such as your configuration preferences, session duration, page views, the content you access, the format of that content, searches you make, and content you bookmark.
- We may use cookies and other tracking technologies to automatically collect technical information about how you use our Websites, applications and related Websites, including URL, cookie data, IP address, device type, unique device IDs, network connection type (e.g., WiFi, 3G, LTE, Bluetooth) and provider, and browser type, browsing and search history. To the extent permitted by applicable law, we use your information to develop and provide our the Websites to you, to personalize, improve and promote our interactions with you and to provide to you third-party services.
Unless we specifically disclose otherwise, you understand that we may use any of your information for any of the purposes described in this Policy (as permitted by applicable law), including:

- If you have a customer account with us, we may collect certain information for security purposes in order to verify your authorized access to your accounts with us.

- We may use your information to administer promotions, contests, and sweepstakes. We may use your information for maintenance purposes, including predictive maintenance, and Website updates.

- With your consent (in applicable jurisdictions) and to the extent legally permissible, Xperi may use and disclose your information to measure your activity and interactions with content and to provision advertising. F. Aggregate/Deidentified Information.
- We may aggregate and/or de-identify any information collected through the Websites. We may use de-identified and/or aggregated data for any purpose, including without limitation for research and marketing purposes, and may also disclose such data to any third parties, including without limitation, advertisers, promotional partners, sponsors, event promoters, and/or others.
The laws in some jurisdictions require companies to tell you about the legal ground they rely on to use or disclose your “personal data” as such term is defined under applicable law. To the extent that those laws apply, our legal grounds are as follows:

- Consent: Where required by law, and in some other cases, we handle personal data on the basis of your implied or express consent.

Legitimate interests: In many cases, we handle personal data on the ground that it furthers our legitimate interests in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals:

- Protecting our customers, personnel, and property

- We may also process personal data for the legitimate interests of our business partners, such as to assist with marketing.
- Legal compliance: We need to use and disclose personal data in certain ways to comply with our legal obligations.
- To protect the vital interests of the individual or others: For example, we may collect or disclose personal data to help resolve a potential security incident.
We will only disclose your information as we have described in this Policy, as explained further below.

A. Third-Party Service Providers.
We may disclose your information to third-party service providers with whom we contract to help us provide our Websites and/or operate our business (including our financial and legal advisors, auditors, service providers and sub-contractors).
B. Xperi Entities. We disclose your information across Xperi entities to support our business operations, to enhance your experiences with our products and Websites, promote our Websites, improve your interactions with us, and to help detect and prevent fraud.
C. Business Partners. We disclose your information to provide you with services that you participate in or request, such as co-sponsors of a promotion that runs on our Websites. In addition, in your interactions with the Websites, it may be necessary for Xperi to sync, link or connect your information with third parties, including providing information necessary to identify or authenticate your requested interactions . Your consent for these interactions will be required by us, by the third party, or by both. We encourage you to review the privacy practices of any third party that you choose to share your information with, as we are not responsible for the privacy practices of third parties.
D. Other Parties When Required by Law or as Necessary to Protect our Users or Websites. We disclose your information as we believe is necessary or appropriate to protect, enforce, or defend the legal rights, privacy, safety, or property of the Websites, our employees or agents or users or the public, or to comply with applicable law or legal process, including responding to requests from public and government authorities.
E. Business Transfers. We may disclose your information in the event that we sell or transfer all or a portion of our business or assets to a third party, such as in the event of a merger, acquisition, or in connection with bankruptcy reorganization, or in contemplation of or due diligence related to such a corporate transaction.
F. Otherwise with Your Consent or At Your Direction. We also disclose your information to third parties whenever you consent to or direct such sharing.
Subject to applicable consent requirements, we may use and allow others to use cookies, web beacons, pixels, local shared objects, device identifiers, and other similar technologies ("Cookies”) to collect information about you. We use this information to improve your experiences when you interact with us. You have control over some of the data we collect from Cookies and how we use it.
We may collect information such as your browser type, the type of operating system you use, device identifiers, the domain name of your Internet service provider, IP address, pages visited on the site, Websites used and how you have used them. We and our advertising partners do this for a variety of purposes. In the case of our advertising partners, one purpose may include the personalization of advertisements based on your visits to sites in that partner’s network.
Your browser may offer tools to limit the use of cookies or to delete cookies; however, if you use these tools, the Websites may not function as intended.
Please note there is currently no accepted standard to respond to Do Not Track signals and that at least some of the Xperi websites do not currently respond to a web browser's Do Not Track instructions. More information about Do Not Track can be found here.
Some analytics providers we may partner with may provide specific opt-out mechanisms. For example, to the extent we use Google Analytics, you may opt out of having Google Analytics use your information for analytics by installing the Google Analytics Opt-out Browser Add-on.
We may partner with ad networks and other ad serving providers ("Advertising Providers") that serve ads on our behalf and others' on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information that Advertising Providers collect about your use of the Websites and other sites or apps over time, including information about relationships among different browsers and products. This type of advertising is known as interest-based advertising.
To the extent that we engage in these practices, we adhere to the Digital Advertising Alliance ("DAA") Self-Regulatory Principles in connection with this interest-based advertising activity. You may visit www.aboutads.info to learn more about this type of advertising and how to opt out of this advertising on websites by companies participating in the DAA self-regulatory program. For Canada, please visit https://youradchoices.ca. If you delete your cookies or use a different browser or mobile product, you may need to renew your opt-out choices exercised through the DAA tool. Note that electing to opt out will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests. If you have enabled a legally recognized browser-based opt out preference signal (such as Global Privacy Control) on your browser, we recognize such preference in accordance and to the extent required by applicable law. You will need to turn this on for each browser you use.
Our Websites are global and your information may be stored and processed in the United States and other countries outside the United States that may have data protection laws that differ from the laws in your country.
Where permitted by applicable law, we may transfer, process or store your information to or in any country or region where we have facilities, business operations, or in which we engage service providers. By using our Websites, you give your consent (where required to do so or where you provide such consent) to the transfer of your information to, and the processing and storage of your information in, countries outside of your country of residence or the point of collection.
Some countries may have data protection laws that are different from the laws of your country that may not be as comprehensive as, or equivalent to, those in the country where you reside/are a citizen.
Data Privacy Framework Principles
Xperi complies with and certifies to the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”) as set forth by the U.S. Department of Commerce. Xperi has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. The following entities have been certified under the EU-U.S. DPF:

As required under the principles, when Xperi receives personal data under the DPF and then transfers it to a third-party service provider acting as an agent on our behalf, we have certain liability under the DPF if both (i) the agent processes the information in a manner inconsistent with the DPF Principles; and (ii) Xperi is responsible for the event giving rise to the damage.
Some international users (including those whose information we collect under the DPF) of our Websites have certain legal rights. Please see the “Your Privacy Rights” section for more information.
In compliance with the EU-U.S. DPF, Xperi commits to resolve EU-U.S. DPF Principles-related complaints about our collection and use of your personal data. If you are a resident of the European Economic Area, and are dissatisfied with the manner in which we have addressed your concerns for personal data covered by the DPF, you may seek further assistance, at no cost to you, from our designated DPF independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please visit www.bbbprograms.org/dpf-complaints.
Residents of the European Economic Area, may elect to arbitrate unresolved complaints but prior to initiating such arbitration, you must: (1) afford us the opportunity to resolve the issue; (2) seek assistance via Xperi’s recourse mechanism above; and (3) contact the U.S. Department of Commerce (either directly or through a European Data Protection Authority) and afford the Department of Commerce time to attempt to resolve the issue. Each party shall be responsible for its own attorney’s fees. Please be advised that, pursuant to the DPF, the arbitrator(s) may only impose individual-specific, non-monetary, equitable relief necessary to remedy any violation of the DPF with respect to the individual.
The Federal Trade Commission has jurisdiction over Xperi’s compliance with the EU-U.S. DPF. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
You have choices about the use and processing of information that identifies you, marketing communications you receive from us, and our use of cookies and other tracking technologies.
A. Managing Marketing Communications From Us.
We will honor your choices when it comes to receiving marketing communications from us. If you have received marketing communications from us that you no longer wish to receive, you may opt out/unsubscribe or adjust your account or device settings. You can also manage your privacy rights here.
While you have the right to select whether you receive marketing or promotional messages, you may still receive other non-promotional messages from us.
B. Your Privacy Rights. Depending on your jurisdiction, including California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia, in addition to residents of the EEA, UK, Switzerland, Brazil, Colombia, or Canada you may have certain rights, in accordance with applicable privacy laws, associated with your “personal information” or “personal data” (as such terms are defined under applicable laws, and collectively referred to herein as “personal data”). Specifically, if you are a resident of any such jurisdiction, you have the right to request that we:

California residents can request categories of sources of such data; the business or commercial purpose for collecting your personal data; the categories of third parties to whom we disclose personal data; and information about the financial incentives that we offer to such residents, if any. Minnesota and Oregon residents can request a list of the specific third parties, other than natural persons, to which we have disclosed personal data.
Residents of certain other countries may be able to request one or more of the above types of information under applicable law.

As provided in applicable law, you also have the right not to be discriminated against for exercising your rights. Please note that certain information may be exempt from such requests under applicable law. For example, we need to retain certain information in order to provide the Websites to you. We also need to take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name and email address.

You can also exercise your right to update/and or correct certain information we collect by logging into your account with the Websites. You may also be permitted to designate an authorized agent to submit requests on your behalf. If you do so, we may ask for information verifying that the rights, please email authorized agent has sufficient authority to make requests on your behalf.
Depending on applicable law, including Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, and Virginia, you may have the right to appeal our decision to deny your request, if applicable. To exercise such an appeal right, please email us at privacyrequest@xperi.com. You also have the right to lodge a complaint with a supervisory authority, if applicable.
Notice of Right to Opt Out of Sales of Personal Data and Processing/Sharing Personal Data for Targeted Advertising Purposes
If you are a resident of certain jurisdictions, including California, Colorado, Connecticut, Maryland, Minnesota, Montana, Oregon, Texas, Utah, and Virginia, you have the right to opt out of “sales” of your information and “sharing/processing of your information for targeted advertising” to the extent that we engage in such practices.
As explained in the “Interest-Based Advertising” section above, we may disclose information to unaffiliated third parties that we collaborate with or that provide offers that we think may be of value to you. We may also provide personal data to third-party advertising providers for targeted advertising purposes. Under applicable law, to the extent that we disclose your personal data to these third parties to assist us in providing these Websites, this may be considered a “sale” of personal data or the processing/sharing of personal data for targeted advertising purposes.

We may also make certain contact information, such as name, email address, phone number, mailing address, to other businesses in a way that is a sale, or share/use for targeted advertising. Residents of applicable states with opt-out rights can opt out of this activity using the opt-out form here.
Please note that we do not knowingly sell or share for targeted advertising the personal data of individuals under 18 years of age.
Xperi retains and uses your information in accordance with and as permitted by applicable law and regulations. How long we retain your information depends on why we collected it, how we use it and legal regulations. We will not retain your personal information for longer than is necessary for our business purposes, to meet your request, or for legal requirements. When no longer required, we will destroy, erase or de-identify the information. Legal requirements may necessitate that we retain some or all of the personal information we hold for a period of time that is longer than we might otherwise hold it.
We take steps intended to provide reasonable and appropriate security measures in connection with securing information we collect. However, you should know that no business can fully eliminate security risks associated with information. While Xperi has endeavored to create secure and reliable products and Websites for its customers, the confidentiality of any electronic communication or material transmitted to/from Xperi cannot be guaranteed.
Xperi Websites are intended for and directed to adults, not children. If you are under 18, do not supply any information to any Xperi Websites for the purposes of using the Websites. If you are aware that we have unintentionally collected information from someone who is under the age of 18, please notify us immediately by sending an email to privacyrequest@xperi.com.
From time to time, we may change or update this Privacy Policy. We will notify you of any changes by posting the new Policy online on this page. To the extent required by applicable laws, we will obtain your consent prior to a material change to this Privacy Policy. Small changes or changes that do not significantly affect individual privacy interests may be made at any time and without prior notice.
If you object to any changes and no longer wish to use our Websites, you may cease use of our Websites and request the deletion of your information, as described in the “Your Rights and Choices Regarding Your Information” section above. All changes to our Privacy Policy are effective immediately upon posting and your continued interaction with us or your use of our Websites or your consent after a posting of an updated Privacy Policy shall constitute your consent to all changes.

Please note, in the limited circumstances that we process sensitive personal information as defined by the CCPA, we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request.
We will take reasonable steps to verify your identity before responding to a request for access and/or deletion from you or your designated agent. If we are unable to verify you, we may be unable to respond to your requests.
The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your rights.
Please note that certain information may be exempt from such requests under California law. For example, we need certain information in order to provide the Websites to you.

Opt Out of “Sale” or “Sharing” of Personal Information. As explained in the “Interest-Based Advertising” section above, we may disclose information to unaffiliated third parties that we collaborate with or that provide offers that we think may be of value to you. We may also provide personal data to third-party advertising providers for targeted advertising purposes. Under applicable law, to the extent that we disclose your personal data to these third parties to assist us in providing these Websites, this may be considered a “sale” or “sharing” of personal information for cross-context behavioral advertising purposes. In connection with such advertising, we may share the following categories of information with advertising networks and providers, advertisers, and social media networks:
- Device information and identifiers, such as IP address, and unique advertising identifiers and cookies; hashed identifiers, such as contact information; usage information, such as browsing history; and location information, such as city.
